Claims Notification Period

Damage to Vessel

  1. A Marine Protest must be served against Asian Terminals, Inc. or ATI Batangas, Inc., whichever is applicable, (the “Operator”) within one (1) hour from occurrence of the incident or before the vessel departs.
  2. The Shipping Agent must notify or file a claim against the Operator within three (3) days from occurrence or knowledge of incident.
  3. Claim supporting documents must be submitted to the Operator within 10 days from receipt of the Operator’s letter/request.
  4. Claim not substantiated within 10 days will be considered waived and abandoned.
  5. For loss/damage exceeding USD35,000, evaluation of the claim will be handled by the Operator’s insurer. Claim for loss/damage below said amount will be handled directly by the Operator’s Insurance & Claims Office (ICO).

Damage to Container/Cargo

  1. Formal claim must be filed within fifteen (15) days from the date of release of cargo to owner, shipper or consignee or its authorized representative.
  2. Claim supporting documents must be submitted to the Operator within 10 days from receipt of the Operator’s letter/request.
  3. Claim not substantiated within 10 days will be considered waived and abandoned.
  4. For loss/damage exceeding USD35,000, evaluation of the claim will be handled by the Operator’s insurer. Claim for loss/damage below said amount will be handled directly by ICO.
